- You must file your case withinthree years of the date of the injury.
- The owner of the dog is determined as liable for the medical costs if:
- The dog attacks and injures or kills a person, farm animal or pet without justification
- The dog behaves in a way that would make a someone believe that the dog poses a serious threat.
- The owner of the dog is liable for other costs (not medical) if negligence is determined. This means that the owner failed to use reasonable care to control their pet. This is sometimes known as the “one bite” rule, as negligence is often determined if the dog has bitten or acted aggressively before.
Exceptions to dog bite cases include a dog that was protecting property, was being abused or tormented, was physically threatened by the person who was bitten, or was acting in response to pain or injury.
